1. Agreement to Terms

By accessing or using KySEE.ai ("Service"), operated by KySEE AI ("Company," "we," "us"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, do not use our Service.

2. Description of Service

KySEE provides AI-powered behavioral profiling for vetting purposes. Our Service includes:

  • • Online interviews for candidates across 9 fixed segments
  • • AI-powered CV vetting
  • • Auditing of Hiring Costs
  • • Consultancy Services

3. Plans and Billing

3.1 Custom Plans

Payment plans are customized according to client's needs and are billed upon client's approval.

3.2 Payment Terms

  • • Invoices are billed monthly/annually in advance
  • • Services auto-renew unless canceled at least 7 days prior to renewal date
  • • All fees are non-refundable
  • • Prices may change with 30 days' notice

4. User Responsibilities

You agree to:

  • • Provide accurate account information
  • • Maintain confidentiality of your account credentials
  • • Not redistribute, resell, or share KySEE interviews or data
  • • Comply with all applicable laws and regulations

5. Disclaimers

IMPORTANT RISK DISCLOSURES:

  • • Profiles are AI generated and are subjective
  • • Profiling Reports do not guarantee results or future behavior of candidate
  • • Reports are informational only, any practical application of their output is not under KySEE responsibility

6. Intellectual Property

All Service content, including but not limited to:

  • • AI algorithms and methodologies
  • • Website content and design
  • • Trademarks and logos

Are owned by KySEE AI and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Service.

7. Prohibited Uses

You may not:

  • • Share or redistribute interviews or reports
  • • Use automated systems to access the Service
  • • Attempt to reverse engineer our algorithms
  • • Manipulate or provide false data
  • • Use the Service for any illegal purpose
  • • Impersonate others or provide false information

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • • We are not liable for any future behaviors or performance of interviewed candidates
  • • We disclaim all warranties, express or implied
  • • We are not responsible for third-party actions
  • • Force majeure events excuse performance

10. Indemnification

You agree to indemnify and hold harmless KySEE AI, its officers, directors, employees, and partners from any claims, damages, or expenses arising from:

  • • Your use of the Service
  • • Your decisions stemming from KySEE reports
  • • Your violation of these Terms
  • • Your violation of any laws or third-party rights

11. Privacy

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

12. Termination

  • • Either party may terminate at any time unless specified under contract between parties
  • • We may suspend or terminate for Terms violations
  • • Upon termination, access to signals ceases immediately
  • • Termination does not affect prior obligations

13. Dispute Resolution

  • • Disputes shall be resolved through binding arbitration
  • • Arbitration shall be conducted in Dubai, UAE
  • • Each party bears its own costs
  • • Class actions are waived

14. General Provisions

14.1 Governing Law

These Terms are governed by the laws of Dubai, UAE, without regard to conflict of law principles.

14.2 Entire Agreement

These Terms constitute the entire agreement between you and KySEE AI regarding the Service.

14.3 Severability

If any provision is deemed invalid, the remaining provisions continue in full force.

14.4 No Waiver

Our failure to enforce any right or provision is not a waiver of such right or provision.

14.5 Assignment

You may not assign these Terms without our written consent. We may assign our rights to any successor.
